The Senate demands that President Sebastián Piñera instruct the Ministry for Foreign Affairs to ask the Swedish government to take back toxic waste from the Scandinavian country that is currently located in Arica.
Between 1984 and 1985, the Swedish company Boliden Mineral AB transported the equivalent of 19,139 tonnes of mining waste with high levels of cadmium, mercury, lead, arsenic and other heavy metals, from Sweden to the city of Arica.
These imports were made through Computador Metalúrgica (Promel) Ltda, a company that would process this material to extract gold, silver and arsenic, even though they were not able to do so. The metallurgical company also received 1762 tonnes of sludge from elsewhere between 1984 and 1989.
This activity ended in neglect and 20,901 tonnes of toxic waste were left near residential areas with a socially disadvantaged population and is one of the largest environmental disasters in domestic history, leading to thousands of people being poisoned by heavy metals with serious health consequences, such as cancer. , bone and respiratory diseases, allergies, anemia, among others.
UN letter
As neither the Chilean nor the Swedish governments took responsibility for the waste, on 23 March 2021, six special rapporteurs from the UN organization sent three letters to the governments of Sweden and Chile, as well as the highest representative of Boliden Mineral AB, to take responsibility for the pollution of Arica in a way that respects the human and environmental rights of the people affected.
Representatives of the international organization urge the Chilean government to provide detailed information on the measures taken and what is being done to protect the rights to life, mental and physical health, housing and drinking water. At the same time, the UN’s special rapporteurs contacted the Swedish government to respond to the possibility of returning the toxic waste to the Nordic country.
The Swedish government replied on 21 May that they did not agree with the statement that Sweden had any obligation regarding the situation in Arica, as this issue has been examined by courts in both Chile and Sweden. In addition, the commitments made by the Swedish government regarding human rights and the environment are described, and how it has implemented the UN’s guidelines and principles.
The Senate requests repatriation of toxic waste
In this situation, the Senate presented a plan calling on President Sebastián Piñera to instruct the Foreign Minister, Andrés Allamand, to ask the Swedish government to “handle the transfer of the 19,139 tonnes of” sludge with metallic content “sent by Boliden Mineral AB, through Sociedad Procesadora Metalúrgica Ltda, from the foundry in Rönnskärsverken, back to their origins when they are able to handle hazardous waste in a correct way. And that Sweden, in good spirit, also takes care of the remaining 1762 tons of sludge with metal content imported by Sociedad Procesadora Metalúrgica Ltda. Deposited in the city of Arica for treatment in Sweden, says the Senate.
In addition to this plan, the Senate wants the President to ask the State Department to “initiate diplomatic efforts” to provide specialized medical assistance to victims of environmental pollution in Arica, as well as the full environmental organization in the area known as Sector F, in the city of Arica.

El parlamentario recordó que “en 1994 me tocó investigar y denunciar el tráfico de residuos peligrosos que trajo de Suecia a Chile la empresa Boliden. Y le pagó a una empresa de delincuentes, Promel, para que acopiara 20 mil toneladas de basura tóxica, con arsénico, mercurio y otras sustancias cancerígenas en un lugar fiscal que arrendaron en el cerro el Chuño (Región de Arica y Parinacota). Luego se construyeron viviendas sobre ellas y cientos de familia resultaron afectadas”.
Girardi agregó que “se ha generado una controversia respecto a la responsabilidad que tendría Suecia y la empresa Boliden. Esta basura tóxica fue llevada a Quebrada Encantada, a cerca de 700 metros, y quedaron abandonadas ahí sin ningún resguardo sanitario adecuado y nunca han sido tratadas, como tampoco los suelos que quedaron contaminados”.
El senador sostuvo que “la comunidad afectada interpuso acciones legales en Suecia, pero los tribunales de justicia suecos rechazaron las querellas con el argumento que habían prescrito. Pero hoy, relatores de derechos humanos de la ONU plantean que se violaron los derechos fundamentales, por lo que se trata de delitos imprescriptibles”.
“Es inaceptable que el Gobierno sueco se desentienda de esta situación, menos cuando va a celebrar Estocolmo + 50, porque en la conferencia de 1972 Estocolmo cuestionó estos tráficos de basura tóxica que países ricos envían a países pobre de África o América Latina transformándolos en un resumidero de basuras que no querían tener”, añadió.
«Se presentan como uno de los países más comprometidos con el Medio Ambiente»
El legislador argumentó que “este tráfico fue totalmente ilegal porque se hizo en el año 85, pero ya en el 84 había una resolución de la OCDE que impedía estos tráficos de residuos peligrosos. Hoy tenemos que Suecia se presentan al mundo como uno de los países más comprometidos con el Medio Ambiente, pero no es verdad porque ampara empresas criminales como Boliden y encubren a delincuentes que transformaron a Chile en un botadero de residuos tóxicos”.
“Recientemente el ministro de Medio Ambiente sueco entregó una declaración donde se abre a revaluar el destino de esta basura peligrosa. Por ello presentamos este proyecto de acuerdo -firmado por más de 25 senadores y senadoras- solicitándole al Presidente Piñera que se inicien todas las acciones para que estos residuos sean devueltos a Suecia y sean tratados allá como corresponde, porque nunca debieran haber salido de ahí”, sentenció Girardi.
